1) Data controller and contact details

Tonas Wood México, SAPI de CV (hereinafter, “Tonas Wood”), with address for hearing and receiving notifications at Uxmal 695, Col. Letrán Valle, Mexico City, CP 03650, Mexico, is responsible for the processing of your personal data in accordance with this Privacy Notice.

2) What information do we collect?

In order to fulfill the purposes described, Tonas Wood may collect and process:

  • Identification and contact: name, address, email, telephone.

  • Tax and billing.

  • Location (for shipping and offers by area).

  • Assets/financial (for payments or credit).

  • Biometrics (fingerprint and facial features) when strictly necessary to verify identity in accordance with applicable regulations.

  • Demographics and consumer habits.

  • Image (photo and/or video) in branches and events.

  • Information generated by sweepstakes, contests and promotions.

  • Voluntary content (complaints, claims, requests).

When you provide third-party data (personal references), you declare that you have their consent in accordance with applicable regulations.

Sensitive data: Tonas Wood does not process sensitive data in the ordinary course of business. If it is exceptionally required, your express written consent will be requested.

Social media: If you contact us through social media, we may process your public profile data to address your request.

3) Minors

We do not collect data directly from minors. If data is provided, it will be deemed that the person providing it is a parent or guardian and accepts this Notice.

4) Automated processing and profiling

To offer you personalized experiences, Tonas Wood may perform automated analysis (without human judgment) and profiling based on your consumption habits, tastes, and interests.

5) Purposes of the treatment

Primary (necessary) purposes:

  • Create and manage your account.

  • Verify identity (including biometric validation against authority records where applicable).

  • Process orders, payments, billing, and clarifications.

  • Contact you for product delivery/tracking and compliance with obligations.

  • Warranties, repairs, maintenance.

  • Fraud prevention and credit monitoring; credit granting and administration.

  • Purchase records, loyalty programs, and promotions; use of images in dynamics when you participate/accept.

  • Video surveillance and security in facilities.

Secondary purposes (optional):

  • Sending advertising, promotions and launches.

  • Market surveys/research and statistics.

  • Contact to offer additional products/services.

  • Share consumer habits with business partners for marketing purposes.

You may object to secondary purposes by sending an email to arco@tonaswood.com.mx The refusal does not affect the primary purposes or the relationship with Tonas Wood.

6) Data transfers

Tonas Wood may transfer without consent:

  • To competent authorities (national/foreign) in the cases provided for by law.

  • To subsidiaries, affiliates and related parties that operate under policies in accordance with the law.

  • To payment processors, courier and logistics, and after-sales services.

  • To Credit Information Societies if there is non-payment.

  • To tax authorities and/or to comply with the Anti-Money Laundering Law.

With your consent, we may share data with business partners for offers/benefits and loyalty programs.

7) ARCO rights and revocation of consent

You or your legal representative may exercise Access, Rectification, Cancellation or Opposition (ARCO), and/or revoke your consent by writing to arco@tonaswood.com.mx .

Procedure requirements (guide):

  • Request the ARCO Form by mail.

  • Attach valid official identification.

  • If you are representing a third party, include representation documents.

Response times: up to 20 business days for the determination and, if applicable, an additional 15 business days for its execution.

If the information is insufficient, we may request clarification within 5 days; you will have 10 days to respond. Failure to do so will result in the application being deemed unsubmitted.

8) Limitation of use or disclosure

To limit use/disclosure:

  • Send your request to arco@tonaswood.com.mx .

  • Set privacy preferences in your account (site or app).

  • Manage cookies in your browser.
    If applicable, we will register it on our Exclusion List.

9) Cookies and similar technologies

We use cookies/web beacons to:

11) “We Are Alebrijes” App (somosalebrijes.tonaswood.com)

Use of the App is part of the Tonas Wood platform and is governed by this Notice.

  • Data that the App may collect: preferences (e.g., colors), style and interests, interaction data (clicks, session time), and information necessary for the personalization experience.

  • Nature of the results: The recommendations and descriptions generated are aesthetic and cultural; they do not constitute deterministic statements about their personality.

  • We do not process sensitive data in the App; if any future functionality requires it, your express consent will be requested.

12) Competent authority

You can contact the federal authority responsible for access to information and personal data protection in Mexico or the corresponding local authority to exercise your rights.

13) Legal Compliance and Limitation of Liability Clause

  • PROFECO: We respect the Federal Consumer Protection Law; our policies will never limit consumers' minimum inalienable rights (e.g., legally compliant repair or replacement for manufacturing defects).

  • Use of products: The use of watches and accessories is at the user's own risk. Tonas Wood is not responsible for allergies, accidents, or personal injuries, except as expressly provided by law.

  • Data protection: We process data in accordance with the LFPDPPP and other Mexican regulations. In the event of international expansion, we will adopt measures to comply with the GDPR (EU) and CCPA (US) where applicable.

  • Third-Party Fraud: Tonas Wood is not responsible for phishing, impersonation, or unofficial sites/apps that mimic the brand. Always verify that you are browsing on official channels.

  • General Disclaimer: Use of our platforms and services is at your own risk. We will not be liable for indirect, special, or consequential damages, except as provided by Mexican law.

14) Changes to the Privacy Notice

Any significant changes will be communicated through:

  • Publication on www.tonaswood.com and/or the App.

  • Email, if you authorized it.

  • Notifications within our applications (if applicable).
    We recommend that you periodically review this Notice.
